Terms of Service

1. About these terms
These Terms of Service (“Terms”) govern your use of EximJinn (the “Service”), a software platform owned and operated by EximJinn Technology Private Limited (“we”, “us”, “our”). By accessing or using the Service, or by accepting these Terms when prompted, you (“you”, the “Client”) agree to be bound by them. If you do not agree, do not use the Service.
2. The Service and its modules
EximJinn brings your Export-Import documentation and related workflows into one place through a set of modules. The available modules may include, for example, bulk e-BRC download from DGFT, EGM & shipping-bill tracking from ICEGATE, analytics, and other modules we may add, remove or change from time to time. These Terms apply to all current and future modules and to any new features, unless a module is accompanied by additional specific terms, in which case those also apply.
Access to individual modules is granted by us or your administrator. A new module is not enabled on your account automatically; it becomes available only when it is explicitly assigned to you.
3. Accounts and eligibility
Accounts are created by us for our clients. You are responsible for the accuracy of the information provided for your account, for keeping your login credentials confidential, and for all activity that occurs under your account. You confirm that any IEC, GSTIN or entity details you provide belong to you or to a person or entity you are authorised to represent.
4. Authorisation to act on your behalf
Where a module requires access to a third-party government or portal (such as DGFT, ICEGATE or similar) using credentials you provide, you authorise EximJinn to access that portal on your behalf solely to retrieve and process your own data for the purpose of that module. You confirm you are entitled to grant this authorisation. Public-enquiry data that requires no login is retrieved from the relevant portal's public interface.
5. Acceptable use
- Use the Service only for lawful purposes and only for accounts, IECs and entities you are authorised to access.
- Keep your login details confidential and do not share your account or resell access without our written consent.
- Do not attempt to disrupt, overload, probe, reverse-engineer, scrape or misuse the Service or the portals it connects to.
- Do not use the Service to infringe any law or the rights of any third party.
6. Data accuracy and third-party portals
Information shown in the Service is retrieved from government or third-party sources (such as DGFT and ICEGATE) and is presented as provided by those sources. We do not originate this data and are not responsible for errors, omissions, delays or changes in it. These portals are operated by third parties and may change, impose limits, or be unavailable at times, which can temporarily affect the Service. Always verify critical figures against the official source before relying on them for filings, refunds or compliance.
7. Not professional advice
The Service, including any analytics, statuses, alerts or knowledge-portal content, is provided for information and convenience only and does not constitute legal, tax, customs, accounting or other professional advice. You remain responsible for your filings and compliance and should consult a qualified professional where appropriate.
8. Subscription, fees and access
Access is provided on a subscription or validity basis agreed with you, and may be limited to the modules assigned to your account. When your validity period ends, you may still sign in to view existing records, but new jobs or lookups may be paused until renewal. Fees, once agreed, are payable as arranged; we may revise plans or pricing on prospective notice.
What a licence is counted against. A subscription is licensed per IEC, and covers up to the number of EximJinn user logins stated in your plan. Your logins on a government portal — including any parent and child DGFT logins under the same IEC — are not EximJinn user logins: you may register as many of them as you hold, and doing so neither adds to nor reduces the licences or user logins on your plan. A separate IEC always requires its own subscription.
9. Availability and changes
We aim for high availability but do not guarantee uninterrupted or error-free service. We may perform maintenance and may add, modify, suspend or discontinue modules or features. We may update these Terms from time to time; when we make material changes we will update the effective date and may require you to accept the updated Terms before continuing to use the Service.
10. Intellectual property, licence and restrictions
The Service — including its software, source and object code, design, structure, user interfaces, workflows, documentation and content (other than your own data) — is owned by EximJinn Technology Private Limited and its licensors and is protected by intellectual-property laws. Subject to these Terms and your subscription, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own internal business purposes for the duration of your subscription. All rights not expressly granted are reserved. Your data remains yours.
Except to the extent this restriction is prohibited by applicable law, you must not, and must not permit anyone else to:
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, structure, or underlying ideas, algorithms or file formats of the Service;
- copy, modify, adapt, translate, or create derivative works of the Service or any part of it;
- sell, resell, rent, lease, sublicense, distribute, or otherwise commercially exploit the Service, or provide it as a service bureau to any third party, without our prior written consent;
- remove, obscure or alter any proprietary notice, branding or attribution;
- access the Service by any automated means (bots, scrapers, crawlers) or scrape, harvest or extract data from it other than through features we provide, or circumvent any rate limit, access control or usage restriction;
- probe, scan or test the vulnerability of the Service, or breach or circumvent any security or authentication measure, except under a security assessment we have authorised in writing;
- use the Service, or any of its ideas, features or documentation, to build or assist in building a competing or substantially similar product or service; or
- use the Service in any way that violates applicable law or infringes the rights of any third party.
Any feedback or suggestions you provide may be used by us without restriction or obligation to you. Breach of this section is a material breach of these Terms and may result in immediate suspension or termination.
11. Confidentiality and security
We treat your data as confidential and apply reasonable technical and organisational measures to protect it, as described in our Privacy Policy. No system is perfectly secure, and you are responsible for safeguarding your own credentials and devices.
12. Limitation of liability
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, EximJinn and EximJinn Technology Private Limited shall not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, data, refunds or incentives, arising from the use of, or inability to use, the Service or from reliance on data retrieved from third-party portals. To the extent liability cannot be excluded, our aggregate liability is limited to the fees paid by you for the Service in the three months preceding the event giving rise to the claim.
13. Suspension and termination
We may suspend or terminate access for breach of these Terms, non-payment, or misuse. You may stop using the Service at any time. On termination, provisions that by their nature should survive (including data accuracy, IP, liability and governing law) will continue to apply.
14. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any applicable law, the courts at Mumbai, Maharashtra shall have jurisdiction over any dispute arising out of or in connection with the Service or these Terms.
